DJ - General Motors Acceptance Corp. is uncertain whether it will be able to complete an attempted sale of a majority stake of its operations, according to a filing with the Securities and Exchange Commission released late Tuesday.

GMAC, the giant finance arm of General Motors Corp. (GM), said in the filing that "we are uncertain at this time if any transaction" will occur for GMAC or any of its subsidiaries, including residential mortgage arm Residential Capital Corp.

GMAC management had hoped a new parent for the company would bring investment-grade credit ratings to the finance business, which was slashed to junk status last year alongside its sliding automotive parent. It was those sub-par ratings that caused GM to consider the sale, which GM chief executive Rick Wagoner announced in October.

Some market participants had expected an announcement on the sale to come as soon as this week.

Jane ... On the May contract (cl06k) I've got a conventional retracement from the 09/01/05 settlement high ($70.29) to 11/29/05 settlement low ($58.31), which has 61.8% at $65.72.

Pivot traders will note WEEKLY R1 at $65.61.

This certainly does look like a bearish wedge building on the May QM (emini crude oil) contract. So the resistance mentioned in Jeff's 10:41 post is reasonable. Link

Nymex Crude Tops $65 On Norway, Nigeria ... DJ - Oil prices rallied more than $1 topped $65 a barrel Tuesday amid supply worries spurred by the threat of a strike in Norway and continuing unrest in Nigeria.

More than 1 million barrels a day of oil production remains shut in in both major oil producing countries, including some 640,000 barrels a day in Nigerian production shut down amid recent militant violence.

The outages come at a time when U.S. refiners wrap up seasonal maintenance work and crank up production for the peak demand spring and summer driving season.

"It is a nagging problem for the market: constant supply issues combined with refiners due to return from turnarounds," said Tom Bentz, an analyst at BNP Paribas Futures.

The May crude contract on the New York Mercantile Exchange rallied $1.04 to hit a high of $65.20 a barrel.

The contract faces resistance in the $65.00-$65.55 area.

"We'll see if we can push it through," Bentz said. "If not look for another failure and sell-off."

The May Brent contract on London's ICE Futures was up $1.06 a barrel at $64.67.

Petroleum products notched big gains. April gasoline rose 3.62 cents to $1.8650 a gallon. April heating oil was up 3.49 cents at $1.8140 a gallon.

The surge in petroleum products was led by news Monday that the giant Hovensa refinery in St. Croix, U.S. Virgin Islands, had delayed restarting a key gasoline producing unit amid a prolonged repair work. News that a fire forced OMV AG (OMV.VI) on Tuesday to shut a crude distillation unit at its 210,000-barrel-a-day Schwechat refinery in Austria added to the buying interest.

Gasoline tends to lead the petroleum complex higher this time of year, but crude appeared to be drawing support from events in Norway and Nigeria.

In Norway, the country's largest private industry union, Fellesforbundet, threatened Tuesday to strike Saturday if an agreement isn't reached with the Federation of Norwegian Industries over pensions and wages by Friday.

The strike would affect 38,000 members in the manufacturing industry, including Norway's shipyards, engineering industry, textiles, construction materials, and manufacturing for offshore oil and gas projects. It wouldn't affect offshore oil and gas production.

Nevertheless, traders and analysts said the threat led a burst of buying by investors already jittery about supplies in major oil producing countries.

Meanwhile, traders remain wary of unrest in Nigeria where militants have targeted the country's oil infrastructure and abducted foreign oil workers.

On Monday, the militants freed the last three of foreign workers they'd been holding for weeks. They said they will not hold hostages in the future but they would continue to attack oil facilities.

"Participants' relief at the release of the hostages in Nigeria was short-lived, once news that Hovensa's St. Croix refinery will take longer to return to service was announced," said John Kilduff, an analyst at Fimat USA in New York.

Dateline WSJ U.S. consumer confidence jumped to a near four-year high in March as households were cheered by a strong start to growth in 2006, a report Tuesday said.

The Conference Board, a private research group, said its index of consumer confidence for the month exceeded forecasters' expectations and moved to 107.2, from the revised 102.7 seen in February. Economists surveyed by Dow Jones Newswires had expected to see a reading 102.0.

The group's report showed few weak spots in terms of consumers' economic views. The March reading represented the second straight month of growth for the consumer confidence index.

The Conference Board said in its report that its present-situation index improved, standing at 133.3 in March, versus the prior month's revised 130.3. Meanwhile, the expectations index gained ground to 89.9, from February's revised 84.2.

"The improvement in consumers' assessment of present-day conditions is yet another sign that the economy gained steam in early 2006," said Lynn Franco, an economist who leads the survey for the Conference Board. But she added, "consumer expectations, while improved, remain subdued and still suggest a cooling in activity in the latter half of this year.

DJ- Citing industry fundamentals, Bear Stearns on Tuesday initiated coverage of Brazilian petrochemicals giant Braskem (BAK) at "underperform."

Although Braskem boasts "a solid management team and world-class disclosure and corporate governance standards, we believe industry fundamentals will continue eroding over the next few years," Bear Stearns said in a research note.

Bear Stearns said Braskem's earning potential was hurt by "the cyclical downturn in petrochemicals margins triggered by capacity expansion in the Middle East." Bear Stearns noted that Braskem, Latin America's biggest petrochemicals company, was already operating at near capacity.

Level 3 Communications (LVLT) $4.47 Link ... Pre-market most active marked higher at $5.12 after the communication service provider raised its estimated quarterly operating income before depreciation and amortization to a range of $140 million to $150 million from a prior level of $105 million to $125 million.

When Level 3 reported its fourth-quarter results in February, the company forecast first-quarter revenue of $760 million to $785 million and annual revenue of $2.95 billion to $3.15 billion.

Lennar (LEN) $60.33 Link ... Called higher at $61.60 after the homebuilder reported better-than-expected Q1 profit and said new orders rose 4%.

The No. 3 U.S. home builder said earnings rose nearly 34 percent to $258.1 million, or $1.58 per share, in the first quarter ended February 28., compared with $192.8 million, or $1.17 per share, in the year-ago quarter.

That beat the average forecast by analysts of $1.54 per share, according to Reuters Estimates, and the company's own view of $1.45 to $1.55 a share.

Revenue rose about 35 percent to $3.24 billion, topping the $3.02 billion average analysts had expected.

Dateline WSJ General Motors Corp., under pressure to turn around its ailing North American automotive operations, said it expects its sales in the region to fall sharply from a year ago as it tries to earn more money selling fewer cars.

GM also is expected to announce as early as today layoffs to cut its U.S. white-collar work force, according to people familiar with the matter. GM has been quietly reducing this work force for years. It also recently scaled back its white-collar severance-package and has cut back on medical coverage and tuition-reimbursement benefits, among other things.

Dateline WSJ White House chief of staff Andy Card has resigned and will be replaced by budget director Joshua Bolten, President Bush announced Tuesday amid growing calls for a White House shakeup and Republican concern about Bush's tumbling poll ratings.

Mr. Bush announced the changes in an nationally broadcast appearance in the Oval Office. "I have relied on Andy's wise counsel, his calm in crisis, his absolute integrity and his tireless commitment to public service," Mr. Bush said. "The next three years will demand much of those who serve our country. We have a global war to fight and win."
